Deep Creek man charged in robbery

Charlotte County Sheriff’s deputies arrested a Deep Creek man after he committed a robbery Tuesday morning, and at 8 p.m. was finally located and additionally charged for drug trafficking. Arrested was Daniel Robert Foley, 27, 100 block of Uruguay Drive.

CCSO received a call at 9:12 a.m. concerning a disturbance in Deep Creek at the intersection of Aysen Drive and Cabello Street. The victim said she and Foley were friends and an argument ensued. She told deputies Foley grabbed her $550 cell phone and said the only way she could get it back was to give him money or take him to a pawn shop to pawn something. When she tried to get her cell phone back, Foley punched her in the face several times. The victim said Foley got out of her car and she drove away. Deputies developed probable cause to locate and arrest Foley. At 8 p.m. CCSO received a call from Perkins Restaurant, 1700 Tamiami Trail, reporting a man was staggering around in the parking lot, possibly high on drugs. When deputies arrived they located Foley, whose speech was slow and slurred. He gave two fictitious names and kept lying about his identity. Foley then gave deputies his wallet that showed his real name. Communications advised Foley had a probable cause affidavit out for the early morning robbery and theft. When deputies tried to handcuff Foley, he refused and was taken to the ground. He continued to violently resist arrest and a Taser was used several times with no affect. Finally, when backup arrived, they were able to subdue and handcuff him. He then refused to enter the patrol car and had to be physically placed inside. Foley was transported to the Charlotte County Jail and a search located 21 hydrocodone tablets, 38 klonopin pills, and six Oxycodone pills in his possession. Foley was charged with robbery by sudden snatching, grand theft, trafficking in hydrocodone, possession of klonopin, possession of Oxycodone, giving false ID to a law enforcement officer, and resisting arrest with violence. He remains in jail on no bond.
