During the last three years, Florida has been up and down regarding excessive noise and noise levels that interfere with other residents’ peaceful living style. It is no secret that our courts have ruled that the State law limiting noise from vehicles (as it was written) is unconstitutional. There are, however, other noises that are a violation of the law.

Two years ago, the City of Bartow updated our code as it relates to unlawful noise. Occasionally, I am asked about it … yes, Bartow does have a noise ordinance and it is enforced when we are made aware of a violation.

Bartow’s Code 38-97 states, “It shall be unlawful for any person to make, continue, or cause to be made or continued, or allow to be made or to be continued on any property within the city any unreasonably loud, excessive, unnecessary or unusual noise. Any person violating any of the provisions of this section or of section 38-98 in this Code shall be punishable by … ”

Simply stated, if you are making enough noise to cause complaints from your neighbors, you are probably in violation. The point is that we live in a close knit society and excessively loud and/or unnecessary noise can be very disturbing to others.

We at the police department enforce the noise ordinance when we are made aware of these issues. It is imperative that you, being a good steward of your community, are mindful of those actions that can disrupt your neighborhood. Noise is noise and it shouldn’t be the reason that you get into trouble with the law.
